Terms of Use
A binding electronic agreement for the free, virtual trading simulator at kuber-tech.com.
These Terms of Use (“Terms”) form an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature. They govern your access to and use of the Kuber Trade virtual trading simulator at kuber-tech.com (the “Platform”), operated by Kuber Trade (the “Company”, “we”, “us”). By accessing, registering for, or using the Platform, you (“User”, “you”) accept these Terms and all policies incorporated by reference. If you do not agree, do not use the Platform.
1. Nature of the service
The Platform is a virtual (paper) trading simulator provided free of charge for education and practice. It uses only virtual money and does not execute real trades or handle real funds or securities. The Company is not a broker, exchange, depository, or investment adviser and is not registered with SEBI in any such capacity. This is explained in full in our Virtual Trading Disclosure and Disclaimer & Disclosures, which form part of these Terms.
2. Eligibility
You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. By using the Platform you represent that you meet these requirements and that the information you provide is accurate.
3. Accounts and registration
- You may need to create an account to access certain features. You are responsible for keeping your login credentials confidential and for all activity under your account.
- You agree to provide accurate information and to keep it updated. We may suspend accounts with false, incomplete, or misused information.
- One person should maintain one account unless we expressly permit otherwise.
4. No fees, no paid products
The Platform is free to use. We do not charge for practice access, and we do not sell courses, subscriptions, memberships, or any other paid product or service through the Platform. The Platform does not accept deposits of real money. Because there is nothing to purchase, no refund, cancellation, or payment policy applies. If we ever introduce a paid feature in future, we will publish separate pricing and refund terms and obtain your consent before any charge.
5. Acceptable use
You agree not to:
- use the Platform for any unlawful, fraudulent, or abusive purpose, or in violation of any applicable law or regulation;
- represent the Platform, its virtual balances, or simulated results as real trading, real money, or a real brokerage account to any third party;
- attempt to gain unauthorised access to, disrupt, overload, reverse-engineer, or interfere with the Platform or its infrastructure;
- scrape, crawl, harvest, copy, mirror, redistribute, or otherwise extract the Platform’s market-data feed or any market data, whether manually or by automated means, or use it to build or populate any other product or service;
- upload malicious code, or infringe the intellectual property or privacy rights of the Company or others;
- use the Platform to provide investment advice to others or to solicit real-money trades.
6. Intellectual property
The Platform, including its software, design, brand elements, text, and graphics, is owned by or licensed to the Company and protected by applicable laws. Except for the limited right to use the Platform for personal, non-commercial practice, no rights are granted to you. Third-party names and marks remain the property of their respective owners.
7. No advice; assumption of risk
You acknowledge that the Platform provides no investment, financial, legal, or tax advice, that simulated results are hypothetical and not indicative of future results, and that any decision you make in real markets is made at your own risk. Real-world trading involves substantial risk, including loss of capital.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we handle your personal data in accordance with the Digital Personal Data Protection Act, 2023 and applicable rules.
9. Disclaimers and limitation of liability
The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any real-world trading or investment loss arising from your use of or reliance on the Platform. The Company’s aggregate liability for any claim relating to the Platform shall not exceed one thousand Indian Rupees (INR 1,000).
10. Indemnity
You agree to indemnify and hold harmless the Company and its officers, employees, and partners from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.
11. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or if we discontinue the Platform. You may stop using the Platform at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) shall survive.
12. Changes to these Terms
We may revise these Terms from time to time. The “last updated” date above reflects the current version. Continued use after changes constitutes acceptance.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the competent courts in India shall have exclusive jurisdiction over any dispute arising out of or relating to the Platform or these Terms.
14. Grievance officer
In accordance with the Information Technology Act, 2000 and the rules thereunder, the current contact details of our Grievance Officer are published within the Kuber Trade app. Grievances are handled by Kuber Trade, and we will address valid grievances within the timelines prescribed by applicable law.
